Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and MehyarSoft LLC ("MehyarSoft," "we," "us," or "our"), the operator of AIMECH.APP. They govern your access to and use of aimech.app and related applications, content, and services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

You must be at least 13 years old and legally able to enter into these Terms. If you are under the age of majority where you live, a parent or legal guardian must approve your use. You must provide accurate account information, protect your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account.

2. The Service

AIMECH.APP provides AI-assisted vehicle information, including symptom analysis, manually supplied OBD-II code explanations, photo observations and text descriptions of sounds, ranked possible causes and confirmation checks, maintenance planning, diagnostic explanations, saved garage history, repair guidance and estimated repair costs. Vehicle profiles support manual identifiers, available NHTSA VIN specifications, model-level recall checks and links to external valuation and selling services. This Safari PWA does not provide direct Bluetooth OBD scanning, verified OEM wiring diagrams, plate-to-VIN or owner lookup, complete title or accident history, or an in-app resale appraisal. Features, limits, and availability may change. We may modify, suspend, or discontinue all or part of the Service as permitted by law.

3. Important Vehicle and Safety Disclaimer

AIMECH.APP does not provide professional mechanical, engineering, legal, insurance, emergency, or roadside services. AI-generated information is educational and informational only. It may be incomplete, outdated, or wrong and is not a diagnosis, safety certification, repair authorization, insurance appraisal, or substitute for inspection by a qualified mechanic or other appropriate professional.

Never rely on the Service when a vehicle may be unsafe to operate. Stop driving and seek qualified or emergency assistance if you observe smoke, fire, fuel odor, loss of braking or steering, severe overheating, unusual wheel or tire behavior, warning signs of imminent failure, or any other dangerous condition. Always follow the vehicle manufacturer's instructions, recalls, service bulletins, laws, and professional advice. You assume all risk from decisions, repairs, purchases, or vehicle operation based on Service content.

If your vehicle shows signs of immediate danger — smoke, fire, a fuel leak, brake or steering failure, or symptoms of exhaust exposure — stop driving, get out, move away, and contact emergency services; do not rely on the Service in an emergency.

Public vehicle data and value limitations

NHTSA specifications are manufacturer-reported factory information, not an inspection or guarantee of current equipment, condition or ownership. Coverage may be incomplete. In-app recalls are matched by year, make and model; they do not establish VIN applicability or unrepaired status. Confirm with NHTSA's VIN lookup or a dealer, even if the in-app check returns no campaigns. Public VIN and recall lookups do not use AI tokens; chat image analysis remains subject to your plan allowance. No paid vehicle database is included in these public lookups.

You must verify VINs and plates entered manually or transcribed from chat images before relying on results. Resale resources are external links, not valuations generated or verified by us, listing services, binding purchase offers, or guarantees of sale proceeds. Third-party terms, fees and availability apply.

4. AI Inputs and Outputs

You retain any rights you have in prompts, photos, vehicle information, and other content you submit ("User Content"). You grant MehyarSoft a worldwide, non-exclusive, royalty-free license to host, process, reproduce, transmit, and display User Content only as needed to provide, secure, maintain, and improve the Service and comply with law.

You represent that you have the rights and permissions needed to submit User Content. Do not submit unlawful content or personal, confidential, or proprietary information belonging to others without authorization. Because AI systems are probabilistic, similar inputs may produce similar outputs for different users, and outputs may not be unique. You must independently verify outputs before acting on them.

5. Subscriptions, Trials, and Billing

Some features require a paid subscription. Subscriptions purchased on this website are processed by Stripe; subscriptions purchased in the iOS app are processed by Apple through the App Store, as described below. Prices, billing intervals, included usage, and trial terms are shown at purchase. Website subscriptions start with a 7-day free trial. Starting a paid trial requires a payment card; the card is not charged until the trial ends, and canceling before the trial ends means you pay nothing. Paid subscriptions automatically renew at the then-current price for the selected billing period unless canceled before renewal. You authorize recurring charges to your selected payment method, including applicable taxes.

In-app purchases. If you subscribe in the iOS app, Apple processes your purchase at the prices shown in the app, and your subscription is billed to your Apple ID. Subscriptions purchased through Apple do not include a free trial. They renew automatically through your Apple ID unless canceled, and you can manage or cancel them in your Apple ID subscription settings. Cancellation of an Apple subscription takes effect at the end of the current billing period.

You may cancel through the billing-management feature in your account. Cancellation generally takes effect at the end of the current paid period unless stated otherwise. Except where required by law or expressly stated at purchase, charges are non-refundable and we do not provide credits for partial periods, unused usage, or account inactivity. We may change prices or plan features prospectively with any notice required by law. Promotional or trial eligibility may be limited, and abuse of trials is prohibited.

6. Acceptable Use

You may not:

• use the Service unlawfully, deceptively, or to harm people, property, or systems;
• interfere with, overload, probe, scan, or circumvent the Service or its security and usage limits;
• reverse engineer, scrape, copy, or access the Service through unauthorized automated means, except where law prohibits this restriction;
• upload malware or content that infringes privacy, intellectual-property, or other rights;
• impersonate another person or misrepresent vehicle, account, or payment information;
• resell, sublicense, or commercially exploit the Service without our written permission;
• use output as a substitute for required professional inspection, regulatory compliance, or safety procedures.

7. Intellectual Property

The Service, including its software, design, branding, text, and non-user content, is owned by MehyarSoft or its licensors and protected by law. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose. No other rights are granted. If you provide feedback, you grant us permission to use it without restriction or compensation.

8. Third-Party Services and Affiliate Links

The Service may use or link to third-party services, data, products, parts, repair providers, or websites. We do not control or endorse them and are not responsible for their availability, accuracy, products, services, or practices. Your dealings with third parties are between you and them. As an Amazon Associate I earn from qualifying purchases. Some parts links go to Walmart through Impact; MehyarSoft LLC may earn a commission on qualifying purchases made through those links. Affiliate relationships do not increase your purchase price and do not replace your responsibility to confirm part compatibility, safety, warranty, and seller terms.

9. Suspension, Termination, and Account Deletion

You may stop using the Service at any time and may request account deletion through the Account page. We may restrict, suspend, or terminate access if you violate these Terms, create risk or legal exposure, fail to pay amounts due, abuse the Service, or if necessary to protect users or systems. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limits of liability, indemnity, and dispute terms.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." MEHYARSOFT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND PROVIDERS DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE OR ANY OUTPUT WILL BE ACCURATE, COMPLETE, SAFE, UNINTERRUPTED, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEHYARSOFT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, USE, GOODWILL, VEHICLE VALUE, BUSINESS, OR OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE, VEHICLE OPERATION, REPAIRS, PARTS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MEHYARSOFT FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100. Some jurisdictions do not allow certain exclusions or limits, so some of the above may not apply to you.

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless MehyarSoft and its affiliates, officers, employees, contractors, licensors, and providers from claims, liabilities, damages, losses, and reasonable costs arising from your User Content, misuse of the Service, violation of these Terms, infringement of another person's rights, or vehicle-related decisions or actions based on Service content.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute not subject to a legally required alternative forum will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to their jurisdiction. Nothing in these Terms limits rights you cannot waive under applicable consumer law.

14. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms and update the "Last updated" date. Material changes will apply prospectively, and we will provide additional notice when required by law. Continued use after revised Terms take effect means you accept them.

15. General Terms

These Terms and the Privacy Policy are the entire agreement concerning the Service unless separate written terms apply. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remainder will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, sale, or transfer of the Service.
